A lot of people are speculating why FOX is just not rushing out a crapper of a movie to keep the rights. I don't think they will because A) the first one wasn't all that great and B) another bad or mediocre movie will negatively impact any future movies (profit) about the character, rendering owning the rights to DD kind of pointless. Maybe FOX will let DD slip and concentrate on making sure they keep FF and the X-Men. I think the FF would be a lot more important to FOX than DD. But what do I know? Something else to consider though too, even if Marvel ends up with the rights to DD again, I think it would be some time before even they could do something meaningful with him, given their film slate. I would hate to see DD 'pigeon holed' into a role, but obviously he could be set up in one of their many movies but I don't think I want DD as an Avenger. Maybe TV show to re-intro DD would be better? Have a 'Law and Order' style tv show with superheroics would be cool. Throw in the Heroes for Hire and that would be one awesome show.
