Superhero Movie. The question is: did they clear the name “superhero” with Marvel and DC?

IndianaJones.com has a new featurette about Indy’s iconic look and trying to recreate it for the new movie.

Apparently, the teaser trailer for Indy and the Kingdom of the Crystal Skull will be attached to The Spiderwick Chronicles when it hits theaters on Thursday. You can catch it earlier than that though on Thursday’s Good Morning America, sometime between 8-9 am. After that, it’ll be available on IndianaJones.com and Yahoo! Movies.

Flinging Foo like no tomorrow
Remember that Wolverine and the X-Men trailer we linked to last week? The one with all the cool rock music? Apparently the folks in our comments section weren’t the only ones who heard the Foo Fighters being played in the trailer, as YouTube started to take it down because of “a copyright claim by the Foo Fighters.” At least one version of it … the version we linked to was taken down due to “a copyright claim by Marvel Entertainment, Inc.” Hopefully you got to see it while it was still up …

I wonder if legally, if Marvel and DC don’t sue them over the use of Superhero in their title, that it would set a legal prescedent to allow others to use Superhero in their own titles. Like the Superhero Happy Hour book that had to change it’s title a while back.

Technically, Marvel and DC’s trademark doesn’t apply to all media. They’ve forced the issue a few times and used when they shouldn’t. Sometimes they get away with it, sometimes not. Technically, I don’t think it would apply to a movie, but don’t be surprised if this thing gets renamed.
The trailer makes the movie look a lot more focused than the previous “____ Movie”s. Maybe they just edited it that way, but it looks like a pretty straightforward parody of the first Spider-Man movie. I’m not sure that’s a good thing, that movie came out awhile ago and there have already been lots of parodies of it.

Having the Indiana Jones featurette and the trailer for SUPERHERO nearby makes for an interesting contrast. The Indy featurette is stylish and beautifully photographed. The trailer for SUPERHERO isn’t just a naked imitation of SPIDER-MAN but has no individual creativity of its own and has mediocre cinematography. Considering how terrible the SCARY MOVIE series is (SCARY MOVIE 3 may well be the worst film I’ve ever seen), listing that as a “credit” at the beginning of the trailer will immediately scare a lot of people off, with good reason, and there’s nothing in the trailer to win them back. While a good parody of the SPIER-MAN films could certainly be made, SUPERHERO is clearly not going to be it.
